People often ask why, when I sell a dog, do I include the full refund guarantee in my pet contracts.  It’s because the purchase being made is of a living, breathing creature.  Not a stick of furniture to be thrown aside when it gets too old and tattered, or goes out of style, or the dog gets ill and vet costs are no longer affordable, or the kids get bored with it, or a couple divorces and can’t decide who gets the dog, so neither one ends up with it.  Life can get messy.

And while I do my best to match a dog to a buyer, there’s no guarantee it will be a perfect fit 100% of the time.  That’s like asking me to stack marbles…

But I can guarantee to give all your purchase price money back if you aren’t happy with the dog for any reason, at any time.  That’s a little easier than stacking marbles… And if a buyer knows he’s getting his or her money back simply for returning a dog he doesn’t want, chances are, there will be fewer abused, neglected or abandoned dogs. They always have a home here at Yankee Acres.

This agreement between Buyer and Seller, herein named, lists the terms of a transaction for the sale of the below captioned animal:

This animal is herein referred to as the “Dog”

Terms and Conditions:

MEDICAL:  The parents of your pup have been tested for MDR1.  The results were __________. If the MDR1 mutant gene is present, the pup should not use Heartgard heartworm medication.  Interceptor is an acceptable substitute or ask your vet for guidance.

REGISTRATION:   AKC Registration will show Limited Registration and YANKEE will prefix the registered name of the dog. Buyer agrees that this dog is not for resale or transfer of registration to any party other than a return to Seller. The Dog must be spayed or neutered prior to 2 years of age.

HEALTH GUARANTEE AND RETURN POLICY:  Seller does as much as possible to ensure that all dogs are healthy. This includes testing of breeding stock for eyes, hips, vWD (unless clear by parentage) and thyroid at appropriate ages, as well as the usual vet checks and appropriate shots. However, the Seller cannot be responsible for the health of a dog not in Seller’s possession, nor predict the future.

Therefore there is a 72 hour health guarantee, after which a refund of the full purchase price stated above will be issued at any time, for any reason, medical or otherwise, providing the Buyer returns the dog alive, with AKC and/or UKC registration papers signed for transfer back to the Seller. In the event the Buyer is unable to produce registration papers, the Buyer, at his expense, must purchase duplicates from AKC  or UKC for a fee. Under no circumstances is the Seller to be held responsible for the cost of any medical services while the dog is in the Buyer’s possession.  Transportation fees/ shipping fees and other expenses related to return of the dog to Yankee Shelties is the sole responsibility of the Buyer. If you feel for any reason that the dog you purchased is not healthy and thriving, please contact Seller for return of the dog.

SEVERIBILITY:   If any provision in this agreement is unlawful or declared unlawful by any court, the unlawful provision shall have no force and effect, and shall have no impact on the remaining provisions.  The remaining provisions shall continue in full force and effect.

I never want to see one of my dogs homeless or in the pound.  And I believe if I am willing to breed, I should be willing to take responsibility for what I have produced… for life.

While I do sell adults that don’t fit into my breeding program, it is always with an eye to a suitable home for them.  Adult dogs at Yankee Acres are evaluated for their ability to produce pups better than themselves. Improvement of the breed is essential, but very difficult. In the past, I had come to the decision that the pack I had with me was a wonderful group of pets, but weren’t making the improvements for which I had hoped. I love each and every one of them and will miss them forever.  But when I see how well they are doing in their new homes, it re-affirms my belief that there are LOTS of good homes waiting for a dog to fill an empty spot.  If there were no good homes, they would stay with me for life, whether they were “useful” for breeding purposes or not.

And remember, the Pet Contract protects you as well.  Having things in writing is always best.
